Terms and Conditions

These Terms and Conditions ("Terms") govern your use of loyalty.littlescholarsnyc.com and your participation in the Little Scholars Loyalty Program (the "Program"), operated by Little Scholars Management LLC ("Little Scholars," "we," "us," or "our").

Please read these Terms carefully. By accessing this website, submitting a registration form, or participating in the Program, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not register for or participate in the Program.

1. The Loyalty Program

The Program is a free and voluntary rewards program for parents and guardians of children enrolled at, or inquiring about enrolling at, a Little Scholars location.

Members earn points for activities such as enrollment milestones and anniversaries, enrolling a sibling, enrolling early, paying tuition and fees on time, participating in extended care and extracurricular programs, leaving a review or completing a feedback survey, and referring a new family or a teacher.

The current list of qualifying activities, point values, available rewards, and redemption thresholds is published on the Program website and forms part of these Terms. We may add, change, or remove any of them at any time, with changes taking effect when published.

Certain referral rewards include a cash bonus in addition to points. Cash bonuses are paid by a method we specify, may require a completed Form W-9, and may be reported to tax authorities where the total value of rewards issued to you in a calendar year meets the applicable reporting threshold. Points themselves have no cash value.

2. Eligibility and Registration

To participate, you must be at least 18 years of age, be a parent, legal guardian, or authorized caregiver of a child who is enrolled at, has a confirmed future enrollment at, or has inquired about enrolling at a Little Scholars location, or whose last enrolled child left within the preceding twenty-four months, and be reachable at a valid United States mobile number or email address.

One Program account is permitted per family. You must provide accurate information and keep it up to date. Little Scholars staff, contractors, and their immediate household members are not eligible to earn or redeem Program rewards unless we state otherwise in writing.

3. SMS and Text Messaging Terms

What you will receive. By opting in, you agree to receive recurring automated text messages from Little Scholars, including points balance updates, points and reward notifications, reward redemption confirmations, appointment and tour reminders, enrollment and program updates, and loyalty-only offers.

How you opt in. You opt in by submitting the registration form at loyalty.littlescholarsnyc.com with your mobile number and checking the consent box, by replying to a keyword we publish, or by giving consent to a Little Scholars representative in person, by phone, or in writing. We do not add mobile numbers to our messaging program without consent.

Message frequency. Message frequency varies based on your activity in the Program.

Cost. Message and data rates may apply. Your mobile carrier's standard rates apply to all messages sent and received. Little Scholars does not charge for participation in the messaging program.

How to opt out. Reply STOP to any message at any time. You will receive one confirmation message and no further marketing or Program messages. You may rejoin at any time by opting in again.

How to get help. Reply HELP to any message, or contact us using the details in Section 10.

Consent is not a condition. Consent to receive text messages is not a condition of purchase, of enrollment in any Little Scholars program or service, or of participation in the Loyalty Program.

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Mobile numbers are shared only with the communication service providers that deliver messages on our behalf, and only as necessary to provide that service.

Delivery. Carriers are not liable for delayed or undelivered messages. We cannot guarantee delivery on all carriers or devices, and supported carriers may change without notice.

Your responsibilities. You must be the account holder or an authorized user of the mobile number you provide, and you must be at least 18 years of age. If you change or relinquish your mobile number, you agree to notify us promptly.

How we handle mobile numbers and other personal information is described in our Privacy Policy.

4. Email Communications

By registering for the Program, you consent to receive Program-related email communications. Marketing emails include an unsubscribe link. Unsubscribing from marketing emails does not withdraw you from the Program, and we may continue to send you account and transactional messages about your points balance and redemptions.

5. Points

Points are earned and held in a single Program account belonging to the family, not to an individual child. Where a family has more than one child enrolled, all points accumulate in the same family account.

Points do not expire while the family account is active. An account is active for as long as at least one child in the family is enrolled or has a confirmed enrollment for a future start date. When the last enrolled child ends enrollment, the account enters a grace period of twenty-four months from that child's last day of attendance, during which all accumulated points remain valid. If the family enrolls another child during the grace period, the account returns to active status and the full balance carries over. At the end of the grace period, any unredeemed points expire and the account is closed.

Points are credited only after the qualifying activity has been verified by Little Scholars. Points earned in error, or in connection with an activity later reversed, cancelled, refunded, charged back, or found to be invalid, may be removed at any time.

Points have no cash or monetary value, are not the property of the member, and may not be sold, transferred, assigned, gifted, bequeathed, or pooled across accounts or families. Rewards may not be exchanged for cash. Some rewards require an actively enrolled child in order to be applied, including tuition and fee credits; during the grace period these may be requested and held until a child is enrolled.

Points are forfeited if you ask us to close your account, or if we terminate your participation under Section 6 or Section 7. Expired or forfeited points cannot be reinstated or replaced.

6. Prohibited Conduct

The following are prohibited: creating more than one account per family; registering under a false or another person's identity; submitting fictitious, self-referred, duplicate, or non-consenting referrals; submitting reviews that do not reflect your honest experience; sending unsolicited bulk messages or spam referencing Little Scholars; representing yourself as an employee or authorized representative of Little Scholars; using bots, scripts, or automated means to interact with the Program; and attempting to manipulate or circumvent Program rules or point calculations.

Where we determine that prohibited conduct has occurred, we may remove points, cancel or reverse redemptions, terminate the account without notice, and decline future participation.

7. Program Changes and Termination

We may modify, suspend, or terminate the Program, in whole or in part, at any time. If we terminate the Program in its entirety, we will notify active members using the contact details on file and provide a period in which eligible points may be redeemed; after that period, unredeemed points are forfeited without compensation. We may terminate or suspend an individual account at any time for breach of these Terms, suspected fraud or abuse, or where eligibility requirements are no longer met.

We may also modify these Terms at any time. Updated Terms are posted on this page with a revised "Last Updated" date, and your continued participation constitutes acceptance.

8. Relationship to Childcare Services

Participation in the Program is a loyalty benefit only. It does not guarantee admission to or availability of a place at any Little Scholars location or program, does not affect waitlist position or enrollment priority, and does not form part of, modify, or supersede any enrollment agreement, tuition agreement, or parent handbook. Where these Terms conflict with your enrollment agreement in relation to childcare services, tuition, or fees, the enrollment agreement controls.

9. Intellectual Property, Disclaimers, and Liability

All content on this website, including the Little Scholars name, logos, trademarks, text, graphics, and photographs, is owned by Little Scholars Management LLC or its licensors and may not be copied, reproduced, distributed, or used without our prior written permission, except that you may view and print pages for your own personal, non-commercial use.

If you submit a review, testimonial, photograph, or other content in connection with the Program, you grant Little Scholars a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in our marketing materials unless you notify us in writing that you withdraw that permission. Where content includes a recognizable image of a child, you confirm that you are that child's parent or legal guardian and consent to its use.

This website and the Program are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the website or the Program will be uninterrupted, timely, secure, or error-free, or that points balances will always be displayed without delay or error.

To the maximum extent permitted by applicable law, Little Scholars Management LLC and its owners, officers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or points, arising out of or relating to the website or the Program. Our total aggregate liability will not exceed the greater of the value of the unredeemed rewards in your Program account at the time the claim arose or fifty United States dollars (US $50). Some jurisdictions do not allow these exclusions, so some may not apply to you. Nothing in this section limits liability for fraud or any liability that cannot be limited under applicable law.

You agree to indemnify and hold harmless Little Scholars Management LLC and its owners, officers, employees, and service providers from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your breach of these Terms, your misuse of the website or the Program, your submission of another person's information without authorization, or your violation of any law or third-party right.

10. Governing Law and Contact

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Kings County, New York.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with the Privacy Policy and the Program rules published on the Program website, constitute the entire agreement between you and Little Scholars in relation to the Program. The Program is void where prohibited by law.
